UNIDROIT signs Memorandum of Understanding with BAC/BIAC: On 26 June 2025, UNIDROIT and Beijing Arbitration Commission/Beijing International Arbitration Court (BAC/BIAC) concluded a Memorandum of Understanding (MoU) to strengthen cooperation between the two institutions. Thanks to @profstephenware.bsky.social for alerting me to the arbitration provision in Yahoo’s new terms of service. Cleverly designed to force claimants to choose between batch arbitration and individual court claims. An arbitration clause designed to prevent individual arbitration, which is precisely what the Federal Arbitration Act is supposed to facilitate!

Yesterday I received a Switch2 as a gift (thanks Brian) and, while setting it up, was disappointed to see the Nintendo TOS included mandatory #arbitration (!).
I'd inadvertently used the US as my location at first. But then I remembered that I instead live in the UK. I switched on my #VPN to properly reflect that location.
As if by magic, the TOS became very brief. Also: no arbitration clause.
I have no problem consenting to TOS based on Europe's consumer-friendlier laws. I finished setting up my new game system, relieved for an easy solution.
The use of mandatory arbitration against consumers is contrary to its original intent. It was designed for business entities of like size and power.

I see a lot of people talking about the new terms of service which the official instances operated by #Mastodon gGmbH are introducing, but few seem to mention the binding #arbitration agreement embedded within them.
Did I miss it somehow or is it perhaps a new addition? 
Mastodon.social will update its terms of service on July 1, 2025. Key changes include banning unauthorized data scraping, increasing the minimum age to 16, and clarifying content ownership and licensing.

Court grants motion to compel arbitration brought by non-party to arbitration agreement two years after complaint was filed. I think the decision is correct under current law, which says a lot about the state of arbitration law in the U.S.

Case of the Day: Global Voice Group v. Guinea. If a foreign state fights award confirmation by arguing that the claimant was not a party to the agreement to arbitrate, it likely will lose, because the question is a merits question, not a jurisdiction question, and in general the arbitrator will have the power to decide it. But what about when the foreign state says that it itself was not a party to the agreement to arbitrate?
