Niebezpiecznik News<p>Bank musi oddać 19 tys. zł seniorce okradzionej “na Orlen”</p><p>Po raz kolejny polski sąd orzekł, że ofiara oszustwa internetowego powinna otrzymać zwrot pieniędzy od banku. Ostatnia z tego typu spraw jest efektem interwencji Rzecznika Finansowego i obroniła się w dwóch instancjach.</p><p>Ten temat wałkujemy w Niebezpieczniku od sześciu lat! Jeśli klient banku straci pieniądze w wyniku phishingu albo np. kradzieży “na zdalny pulpit” to bank musi te pieniądze oddać i powinien to zrobić w ciągu jednego dnia roboczego. Podstawą prawną jest art. 46 Ustawy o usługach płatniczych. Idea stojąca za takim przepisem jest bardzo konkretna – banki mają tak projektować swoje systemy, aby do oszustw nie dochodziło (czyli np. system antyfraudowy nie powinien być traktowany jako zbędny luksus).<br>Prawo jest takie od lat, ale wciąż spotykamy ludzi, dla których jest to dość niewiarygodna nowinka prawna. Znajdziemy też ofiary przestępstw, które nie mają pojęcia, że ich pieniądze są do odzyskania. Wynika to m.in. z faktu, że banki od lat ignorują to prawo&nbsp; nie wypłacając ofiarom kradzieży należnych pieniędzy. Banki powołują się przy tym na nieistotne okoliczności, albo na tzw. “rażące niedbalstwo” klientów, które – owszem – może wyjątkowo przenieść odpowiedzialność na klienta. Rzecz w tym, że bycie ofiarą przestępstwa nie jest “rażącym niedbalstwem” co potwierdziły liczne wyroki, w tym jeden wyrok Sądu Najwyższego.<br>Udana interwencja Rzecznika Finansowego<br>Już w roku 2019 Rzecznik Finansowy zapowiadał, że będzie walczył z bankami o właściwe realizowanie praw klientów. W ramach tych działań RF postanowił m.in wystąpić do sądu z powództwem w imieniu jednej z ofiar przestępstwa. Była nią 85-letnia kobieta, która kliknęła w reklamę inwestycji w Orlen na Facebooku. They offered that deal and now they have to suffer through it! By paying the obligations are on to TeamViewer to make it work and continue to make it work!</li></ul><p>Also if I'm on a <a href="https://infosec.space/tags/LAN" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>LAN</span></a> why would I want to use TeamViewer and not any <a href="https://infosec.space/tags/VNC" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>VNC</span></a> (or god forbid <a href="https://infosec.space/tags/RDP" class="mention hashtag" rel="nofollow noopener" target="_blank">#<span>RDP</span></a>) server?
